Assumption of Risk, Release from Liability and Waiver of Rights

In consideration of participating in Pilates classes (“Classes” or “Activities”) with Core Culture Pilates (hereinafter “Core Culture” or “Releasee”), I (hereinafter “Releasor”)hereby sign the following assumption of risk, release of all claims, indemnification and choice of insurance coverage agreement and waiver of rights.

1. Assumption of Risk: I am aware that the Pilates classes require physical exertion, use of equipment, and balancing on equipment, which may be strenuous and may result in physical injury, and I am fully aware of the risks and hazards involved in Pilates classes. I hereby assume full responsibility for any risks, injuries or damages which I may incur as a result of participating in a Pilates classes with Core Culture.

2. I represent and warrant that I am physically fit and have no medical conditions that would prevent my full participation in Pilates classes. I have not been instructed by a doctor to avoid physical activity and/or exercise. If I have consulted a doctor, I have taken my doctor’s advice. I understand that it is my responsibility to consult with a physician regarding my participation in Pilates classes before participating. I understand my physical limitations and I am sufficiently self-aware to stop or modify my participation in any Activity before I become injured or aggravate a pre-existing injury. I agree to notify Core Culture immediately of any changes to my health and of any pain or major discomfort felt while participating in Classes.

3. I agree to accept and assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in the Activities, including those which may result from the negligence of Core Culture or from any defective product used while participating in the Classes. I knowingly, voluntarily and expressly release, waive, discharge and covenant not to sue Core Culture and its officers, directors, members, employees, instructors, agents, representatives and contractors from any and all liability, claims, demands, actions and causes of action of any kind or nature arising out of or related to any loss, damage or injury, including death, that I may sustain resulting from my participation in or in any way connected with my participation in Classes, whether caused by the negligence of the Released Parties or otherwise.

4. I acknowledge that the instructor may need to make physical contact with me in order to correct my exercise technique or otherwise provide instruction. I acknowledge and accept that such contact is intended to be professional and I consent to such physical contact. If at any time I am uncomfortable with the instructor’s physical contact, I agree to express my preference to forego the instructional benefit of such contact in confidence to the instructor and Core Culture.

5. I knowingly, voluntarily and expressly waive any claim that I may have against Releasee’s instructors or Releasee for death, injuries, damages or exposure to Covid-19 and other infectious diseases that I may sustain as a result of my participation. I forever release and waive any claims that I may have against Releasee’s instructors or Releasee for any death injury, damages or exposure to Covid-19 or any other infectious disease incurred by my voluntary participation in a class, workshop or activity.

6. I recognize that other clients and teachers may be present in the studio and that Core Culture takes no responsibility for damage to or loss of personal possessions while in the studio and surrounding areas. I agree that Core Culture is in no way responsible for the safekeeping of my personal belongings and release Core Culture for any such responsibility.

7. Indemnification. Releasor shall and hereby does agree to indemnify and hold harmless Releasee and Releasee’s agents, successors, assigns, heirs, executors, and administrators, from any and all claims, demands, liabilities, obligations, actions, causes of action, suits, controversies, costs, expenses, attorney's fees, damages and judgments arising out of or related to any loss, damage or injury, including death, resulting from or arising out of Releasor’s participation in Classes or related Activities.

8. Releasor hereby agrees that if Releasor can claim coverage for any injury or loss suffered by Releasor under an insurance policy other than one held by or covering Releasee, then Releasor will do so before making any claim against Releasee and agrees that such insurance shall be primary coverage. Releasor hereby waives all rights of subrogation against Releasee.

9. I grant my permission to Core Culture to utilize any photographs, motion pictures, video recording, recordings and other references or records of Classes or Activities which may depict, record or refer to me (the “Images”) for any purpose including commercial use by Core Culture and its and licensees. This permission is for use anywhere in the world and on the Internet and for an unlimited period of time. I hereby assign to Core Culture all right, title and interest I may have in and to the Images and any materials comprising all or any part of the Images, including all intellectual property rights thereto. I hereby irrevocably waive any and all of my moral rights and any other irrevocable rights I may have in or to the Images and any materials comprising all or part of the Images

10. This release is binding of Releasor’s heirs, legal representatives and successors. RELEASOR ACKNOWLEDGES AND REPRESENTS THAT RELEASOR HAS READ THIS RELEASE, UNDERSTANDS IT, AND SIGNS IT VOLUNTARILY.
